1. Agreement to These Terms

By creating an account or using the Alpen Table platform, you agree to be bound by these Terms of Service. If you are using Alpen Table on behalf of a business, you confirm that you have authority to bind that business to these terms.

These terms form a contract between you and Take a Seat Ltd., incorporated in Zürich, Switzerland ("we", "us", "our"). If you do not agree to these terms, do not use the service.

2. The Service

Alpen Table is a restaurant reservation management platform that allows restaurant operators to receive, manage, and communicate about guest bookings. It includes a management dashboard, a guest-facing booking interface, an embeddable widget, and a QR code booking flow.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

3. Accounts and Eligibility

To use Alpen Table, you must:

  • Be at least 18 years old.
  • Provide accurate and complete information when creating your account.
  • Keep your login credentials confidential and not share them with unauthorised parties.
  • Notify us promptly at team@alpentable.com if you suspect unauthorised access to your account.

You are responsible for all activity that takes place under your account.

4. Acceptable Use

Alpen Table is designed for legitimate restaurant reservation management. You agree to use the platform only for its intended purpose and not to:

  • Use automated scripts, bots, or any non-human means to create, cancel, or modify reservations.
  • Create fake, test, or fictitious reservations beyond what is necessary for initial onboarding.
  • Use the platform to send unsolicited communications (spam) to guests or third parties.
  • Attempt to probe, scan, or test the vulnerability of the platform or circumvent any security measures.
  • Interfere with or disrupt the integrity or performance of the service or the data it contains.
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform.
  • Resell or sublicense access to the platform without our prior written consent.
  • Violate any applicable law, including data protection laws, in your use of the platform.

5. Fair Use of "Unlimited Reservations"

Our plans advertise unlimited reservations. This means there is no per-booking fee and no hard cap on the number of reservations a restaurant can receive through normal operations.

"Normal operations" means reservation volume that is consistent with your venue's actual seating capacity, opening hours, and genuine guest demand. It does not include:

  • Automated or bulk reservation creation not initiated by real guests.
  • Using Alpen Table as a load-testing environment or for performance benchmarking.
  • Operating multiple venues under a single account intended for one venue.

If your usage is significantly outside normal operating patterns, we will contact you first to discuss the situation before taking any action. We will not suspend or restrict your account without prior notice except in cases of abuse.

6. Guest Data and Your Responsibilities

As a restaurant operator, you collect personal data from your guests (names, emails, phone numbers) through the Alpen Table platform. You are an independent data controller for that guest data and are responsible for:

  • Having a lawful basis to collect and process guest data under applicable privacy law.
  • Maintaining your own privacy notice that informs guests how their data is used.
  • Not using guest contact details for purposes beyond managing their reservation without appropriate consent.
  • Deleting guest data you no longer need.

7. Subscription, Billing, and Refunds

Alpen Table is offered on a monthly subscription basis. By subscribing, you authorise us to charge your payment method at the start of each billing period.

  • Free trial: New accounts receive a 7-day free trial. No credit card is required to start. You will be asked for payment details before the trial ends if you choose to continue.
  • Cancellation: You may cancel at any time. Your access continues until the end of the current billing period.
  • Plan changes: You may switch between plans at any time. Changes take effect at the start of your next billing period.
  • Price changes: We will give at least 30 days' notice before changing subscription prices.

8. Intellectual Property

All rights in the Alpen Table platform, including its software, design, and content, are owned by Take a Seat Ltd. or its licensors. These terms do not grant you any rights to our intellectual property beyond the right to use the service as described here.

You retain ownership of any content you upload or create within the platform (e.g., your restaurant details, table configurations). By providing this content, you grant us a limited licence to host and display it solely to deliver the service.

9. Availability, Accuracy, and Warranties

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. The service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by applicable law.

No uptime guarantee. We do not commit to any specific level of service availability (SLA). The platform may be unavailable at times due to scheduled maintenance, infrastructure issues, or circumstances beyond our control. We will endeavour to communicate planned downtime in advance where possible.

No accuracy guarantee. Reservation data, availability displays, calendar information, and any other content generated or shown by the platform may on occasion be incomplete, delayed, or inaccurate due to software errors, synchronisation delays, or third-party dependencies. You should not rely solely on the platform as the authoritative record of your reservations.

We are not liable for losses arising from service downtime, data loss, or errors in the platform. We strongly recommend keeping your own records of reservations for business continuity purposes.

10. Limitation of Liability

To the fullest extent permitted by Swiss law, Take a Seat Ltd.'s total liability to you for any claim arising out of or related to these terms or the service shall not exceed the total amount you paid us in the 3 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or special damages, including lost revenue or lost bookings, even if we have been advised of the possibility of such damages.

11. Termination

You may terminate your account at any time from your account settings or by contacting us at team@alpentable.com.

We may suspend or terminate your account if you materially breach these terms, with or without notice depending on the severity. In cases of suspected fraud or illegal activity, we may terminate immediately and without refund. In all other cases, we will give you reasonable notice and an opportunity to remedy the breach before terminating.

Upon termination, your access to the platform will cease. We will retain your data for the periods described in our Privacy Policy.

12. Governing Law and Disputes

These terms are governed by the laws of Switzerland. Any disputes arising out of or related to these terms or the service shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland.

Before initiating formal proceedings, we encourage you to contact us at team@alpentable.com so we can try to resolve any issue informally.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.

If you do not agree to the updated terms, you may cancel your subscription before the changes take effect.
